Definitions
“User” means any person or entity accessing or using the services provided by STANDARD 13 Sp. z o.o.
“Services” refer to the digital asset-related services, including cryptocurrency exchange, onboarding and verification, provided by us under the brand Border X Digital.
“Digital Assets” mean cryptocurrencies or virtual tokens supported on our platform.
“We”, “Us”, “Our” refer to STANDARD 13 Sp. z o.o., trading as Border X Digital.
These Terms & Conditions (“Terms”) govern your use of our services. By accessing or using any of our services, you accept and agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you should not use our services.
You must be at least 18 years of age and have full legal capacity to enter into binding agreements in order to use our services. By using our services, you confirm that you meet these requirements.
STANDARD 13 Sp. z o.o., a registered and licensed Virtual Asset Service Provider (VASP) in Poland, offers cryptocurrency-related services including exchange and onboarding. We reserve the right to update or discontinue any aspect of our services without prior notice.
We are subject to AML/CTF laws and require all users to complete Know Your Customer (KYC) verification. You agree to cooperate with all requests for documentation and identity verification. Failure to do so may result in denial or suspension of service.
Trading and holding cryptocurrencies involves significant risk, including market volatility and the potential loss of capital. By using our services, you acknowledge that you understand and accept these risks. We do not provide investment or financial advice.
Prices of digital assets are highly volatile and may be affected by external factors such as regulatory changes, market manipulation or technical issues. You should never trade more than you are willing to lose. We do not guarantee the future value or security of any digital asset, nor do we provide investment advice.
You agree to use our services only for lawful purposes and in compliance with all applicable laws. You may not use our platform to:
Violate any regulation or engage in fraud
Manipulate markets or prices
Attempt to gain unauthorized access to our systems
Use automation (bots/scripts) to abuse the platform
We reserve the right to investigate and take appropriate action, including terminating services.
7. Taxes
You are solely responsible for reporting and paying any applicable taxes related to your use of our services, in accordance with the laws of your country of residence or citizenship.
8. Third-Party Services
We may use external providers (such as Sumsub for verification). While we take reasonable steps to ensure their reliability, your interaction with these services is governed by their own terms and privacy policies. We are not liable for disruptions, losses, or misuse of data caused by these third parties.
9. Intellectual Property
All content, design, logos and technology used in connection with our services are the intellectual property of STANDARD 13 Sp. z o.o. or our partners. You may not reproduce, distribute or use them without prior written consent.
10. Service Availability and Termination
We aim to provide uninterrupted access to our services but cannot guarantee availability at all times. We reserve the right to suspend, restrict or terminate your access if we believe you have violated these Terms, the law or our compliance standards.
11. Force Majeure
We shall not be held liable for any failure or delay in performance due to events beyond our reasonable control, such as natural disasters, war, government action, internet outages, or third-party service failures.
12. Limitation of Liability
To the fullest extent allowed by law, we shall not be liable for any indirect, incidental or consequential damages arising from your use of our services. Our total liability shall not exceed the total amount you paid us for services in the last 12 months.
13. Indemnity
You agree to indemnify and hold harmless to STANDARD 13 Sp. z o.o., its officers, employees and agents from any claims or liabilities arising out of your use of the services or your violation of these Terms.
14. Changes to These Terms
We may update these Terms at any time. When we do, we will post the new version on our website with an updated effective date. Your continued use of our services after changes are posted means you accept the updated Terms.
15. Dispute Resolution & Governing Law
If you have a concern or dispute, please contact us first so we can try to resolve it informally. If we cannot resolve the issue within 30 days, either party may initiate formal legal proceedings.
These Terms shall be governed by and interpreted in accordance with the laws of Poland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Polish courts.
